These Terms of Service ("Terms") govern your use of the website and Care Vault service operated by [Company legal name] Ltd ("we", "us", or "our"). Care Vault is a private online vault for pre-need planning — recording funeral wishes, organising key contacts, and storing important documents before they are needed.

By creating an account, accessing, or using our service, you agree to these Terms and our Privacy Notice. If you do not agree, please do not use Care Vault.

2. The service

Care Vault helps you organise information for the future in plain language. Features may include guided sections for funeral wishes, emergency contacts, document uploads, family sharing, and account management tools.

Important: Care Vault is an organisational tool. We are not a law firm, will-writing service, funeral director, financial adviser, or regulated healthcare provider. Nothing in the service constitutes legal, financial, medical, or funeral advice.

Wishes and notes you record in your vault are expressions of preference. They are not legally binding documents unless you separately create and execute valid legal instruments (for example, a will witnessed according to UK law). Documents you upload remain your responsibility — we do not verify their legal validity.

Care Vault is designed for pre-need planning, not for arranging funeral or bereavement services after a loss. Features labelled as coming soon may not yet be available.

3. Eligibility

You must be at least 18 years old and resident in the United Kingdom (or otherwise in a territory where we make the service available) to create an account. By using the service, you confirm that you meet these requirements and that all registration information you provide is accurate and current.

4. Your account

You are responsible for maintaining the confidentiality of your sign-in credentials and for all activity under your account. Notify us promptly at hello@hellokinsupport.xyz if you suspect unauthorised access.

We may suspend or close accounts that violate these Terms, pose a security risk, or remain inactive for an extended period (with notice where reasonable).

You may delete your account at any time from your account settings. Deletion is permanent and removes your access to vault content, subject to our data retention practices described in the Privacy Notice.

5. Your content and vault data

You retain ownership of the content you add to your vault, including text, wishes, contacts, and uploaded files ("Your Content").

You grant us a limited licence to store, process, back up, and display Your Content solely to provide and improve the service — including sharing it with people you invite according to the permissions you set.

You are responsible for ensuring Your Content is accurate, lawful, and does not infringe anyone else's rights. Do not upload content you do not have permission to share.

6. Inviting others

You may invite trusted people to view or help maintain your vault. Different roles (such as owner, co-planner, or viewer) carry different levels of access, as described in the product.

By inviting someone, you confirm you have their permission to share their contact details and any information about them contained in your vault. Invited users must accept these Terms and the Privacy Notice before accessing shared content.

You are responsible for managing who has access and reviewing permissions regularly. We are not liable for disclosure caused by permissions you set or invites you send.

7. Acceptable use

You agree not to:

  • use the service for any unlawful purpose;
  • upload malware, offensive material, or content that harasses or endangers others;
  • attempt to gain unauthorised access to other users' vaults, our systems, or third-party services;
  • scrape, reverse engineer, or overload the service (except as permitted by law);
  • resell or commercially exploit the service without our written consent;
  • misrepresent your identity or impersonate another person.

We may remove content or restrict access that breaches these rules.

8. Pricing and subscriptions

Core features may be available free of charge. Paid tiers for family sharing, document storage, or other features may be introduced later. Where fees apply, we will show the price clearly before you commit.

If you subscribe to a paid plan, additional payment terms will apply at checkout. Subscriptions renew automatically unless cancelled in accordance with those terms and applicable consumer law (including your 14-day cancellation rights for distance contracts where relevant).

9. Our intellectual property

The kins. name, logo, website design, software, and documentation are owned by us or our licensors. You may not copy, modify, or distribute them except as allowed by these Terms or with our written permission.

You may use the service for your personal, non-commercial pre-need planning. Business or white-label use requires a separate agreement.

10. Availability and changes

We aim to keep Care Vault available and reliable, but we do not guarantee uninterrupted access. Maintenance, updates, or events outside our control may cause temporary downtime.

We may add, change, or remove features. Where a change materially reduces functionality you have paid for, we will provide reasonable notice and, where required by law, a remedy.

11. Limitation of liability

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.

Subject to the above, we are not liable for:

  • decisions made by you, your family, or professionals based on information in your vault;
  • loss of or inability to access Your Content caused by your actions, third parties, or events beyond our reasonable control;
  • indirect, consequential, or economic loss (such as lost profits);
  • content or services provided by third parties (including linked websites).

Our total liability to you for any claim arising from these Terms or your use of the service is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) £100.

You use Care Vault at your own risk. We recommend keeping independent copies of critical legal documents and seeking professional advice where appropriate.

12. Indemnity

You agree to indemnify us against claims, losses, and reasonable costs arising from Your Content, your breach of these Terms, or your violation of another person's rights — except to the extent caused by our negligence or breach.

13. Termination

You may stop using the service and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms, with notice where practicable.

Sections that by their nature should survive termination (including intellectual property, limitation of liability, indemnity, and governing law) will continue to apply.

14. Privacy

Our Privacy Notice explains how we collect and use personal data. By using the service, you acknowledge that processing as described there.

15. Governing law and disputes

These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that if you are a consumer resident in Scotland or Northern Ireland you may also bring proceedings in your local courts.

If you are a consumer, you may use alternative dispute resolution schemes or the EU/UK online dispute resolution platform where applicable. Nothing in these Terms affects your statutory rights as a consumer under UK law.

16. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not transfer your account or rights under these Terms without our consent; we may transfer our rights as part of a business reorganisation.

We may update these Terms. We will post the revised version on this page and update the "Last updated" date. Material changes will be communicated by email or in-product notice where appropriate. Continued use after changes take effect constitutes acceptance, to the extent permitted by law.
